1. ACCEPTANCE OF TERMS

2. PRODUCT NATURE (ANTIQUES & VINTAGE)
Many items sold by Odette are antique, vintage, or handcrafted and are not in new condition. By purchasing, you acknowledge:
- Signs of age, patina, wear, and variation are inherent and intentional
- Measurements are approximate
- Color may vary due to lighting, photography, and screen differences
- No two pieces are identical
All items are sold as-is unless explicitly stated otherwise.
3. PRICING & ERRORS
We reserve the right to:
- Correct pricing, description, or inventory errors at any time
- Cancel or refuse orders placed with incorrect pricing
- Limit quantities or discontinue items
If your order is canceled, you will receive a full refund.
4. PAYMENT TERMS
Payment is required in full prior to shipment unless otherwise agreed in writing. We accept payments via approved methods through our platform.
5. SHIPPING & DELIVERY (FURNITURE + FREIGHT)
Standard Shipping
Smaller items may ship via parcel carriers (UPS, FedEx, etc.).
Freight / White Glove Delivery
Large items are shipped via third-party freight carriers.
You agree that:
- Delivery timelines are estimates only
- You (or an authorized party) must be present at delivery
- Clear access must be provided (doorways, stairs, elevators, etc.)
- Additional fees may apply for redelivery, storage, or special handling
Odette is not responsible for delays caused by carriers, weather, port congestion, or force majeure events.
6. INSPECTION & DAMAGE CLAIMS (CRITICAL)
All deliveries must be inspected at the time of delivery.
- Any visible damage must be noted on the delivery receipt BEFORE signing
- You must notify Odette within 48 hours of delivery with photos
- Failure to note damage at delivery may void your claim
Odette will assist in filing claims, but liability is limited to the terms of the carrier.
7. RETURNS, REFUNDS & CANCELLATIONS
All Sales Final
Due to the nature of our inventory, all sales are final.
Exceptions (at Odette’s discretion only):
- Significant undisclosed damage
- Incorrect item received
Order Cancellations
- Orders may not be canceled once processing or shipping has begun
- Custom, COM, or made-to-order items are non-cancelable and non-refundable
8. CUSTOMER’S OWN MATERIAL (COM)
For upholstery using customer-provided materials:
- Customer is responsible for correct yardage and material suitability
- Odette is not responsible for flaws in supplied fabric
- Variations in dye lots, wear, or performance are the customer’s responsibility
- COM orders are final sale and non-returnable
9. TRADE PROGRAM
Trade accounts require a valid resale certificate.
Odette reserves the right to:
- Approve or deny applications
- Revoke trade status at any time
- Modify trade pricing or benefits without notice
10. STORAGE & ABANDONED ITEMS
If delivery cannot be completed:
- Storage fees may apply after [30] days
- Items not claimed within [90] days may be considered abandoned
11. LIMITATION OF LIABILITY
To the fullest extent permitted by law:
- Odette is not liable for indirect, incidental, or consequential damages
- Liability shall not exceed the purchase price of the item
12. WARRANTIES DISCLAIMER
All products are provided “as is” without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.
13. INTELLECTUAL PROPERTY
All website content—including images, branding, and text—is owned by Odette Collective and may not be used without written consent.
14. GOVERNING LAW
These Terms are governed by the laws of the State of Alabama.
15. CHANGES TO TERMS
We may update these Terms at any time. Continued use of the site constitutes acceptance.
